Version 2.4 — Effective date: October 2026
1. Scope and Covered Services
These Terms of Service ("Terms") govern your access to and use of the URL shortening, link management, and subdomain services provided by Subdomain LTD / GoMaKe UG ("Provider", "we", "us") across our domain ecosystem, including lowend.vip, low.lc, and associated vanity subdomains. By creating an account or generating a shortened link, you agree to be bound by these Terms.
2. Service Provision & Availability
The Service is provided primarily as a free community utility. The Provider endeavors to maintain high availability via edge-cached Anycast infrastructure, but does not guarantee 100% uninterrupted uptime or error-free operation. The Provider reserves the right to maintain, upgrade, or modify features at any time.
3. User Obligations & Strict Trademark Protection
The User agrees to comply with all applicable local, European, and international laws. In particular:
- The User shall not use the Service to distribute content that infringes upon third-party copyrights, patent rights, privacy rights, or registered trademarks.
- Prohibition of Cybersquatting: Claiming vanity subdomains or link slugs that correspond to third-party brand names, hosting provider names, or trademarks without legitimate authorization is strictly prohibited. The Provider reserves the right to reassign or revoke any subdomain or alias upon receiving a substantiated third-party trademark notice.
- Shortening links to prohibited materials (phishing, malware, CSAM, terroristic propaganda, illegal trade) is strictly forbidden.
4. Indemnification by the User (Freistellung)
The User agrees to indemnify, defend, and hold harmless Subdomain LTD, GoMaKe UG, its managing directors, officers, employees, and infrastructure partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney and court fees) arising out of or related to:
- Any content, link, or destination URL shortened or configured by the User;
- Any infringement of third-party trademark, copyright, or intellectual property rights committed via the User's link aliases or vanity subdomains;
- Any breach of these Terms or applicable statutory law by the User.
5. Immediate Suspension & Takedown Rights
The Provider maintains a strict Notice-and-Action policy in accordance with Art. 16 of the Digital Services Act (DSA). The Provider reserves the right to immediately suspend, delete, or null-route any link, alias, vanity subdomain, or user account without prior notice if there is credible suspicion of a legal violation, abuse report, or trademark infringement.
6. Limitation of Liability
Under statutory German law, the Provider is liable without limitation only for damages resulting from intentional misconduct (Vorsatz), gross negligence (grobe Fahrlässigkeit), or injury to life, body, or health. In cases of slight negligence (einfache Fahrlässigkeit), liability is limited to the breach of essential contractual obligations (Kardinalpflichten) and strictly capped at the foreseeable, typical contractual damage. The Provider assumes no liability for loss of profits, indirect business interruption, or data loss occurring on destination servers.
7. Governing Law & Jurisdiction
These Terms and all legal relations between the parties shall be governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Where legally permissible, the exclusive place of jurisdiction for all disputes arising under or in connection with these Terms shall be Freiburg im Breisgau, Germany.
