1. Scope and Acceptance
These Terms of Service ("Terms") govern your use of the URL shortening services provided by WNY IT Services, Inc. ("Provider", "we", "us"). By accessing or using our Service, you agree to be bound by these Terms.
2. Service Description
The Provider offers a service to shorten URLs and manage subdomains. The basic service is provided free of charge. There is no legal claim to the availability of the service. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
3. User Obligations & Acceptable Use
You agree not to use the Service to shorten URLs that lead to content violating German law, US law, UK law, European law or our Community Rules. Prohibited content includes, but is not limited to:
- Copyright infringement and piracy.
- Hate speech, extremism, or incitement to violence.
- Malware, phishing, or deceptive practices.
- Adult content
4. Termination and Suspension
We reserve the right to delete links and suspend or terminate user accounts immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
5. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE PROVIDER MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE RELIABILITY, ACCURACY, OR AVAILABILITY OF THE SERVICE. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
6. Limitation of Liability
In no event shall WNY IT Services, Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The place of jurisdiction is, as far as legally permissible, the registered office of GoMaKe UG.
